These Terms govern use of The Rx Spot website, portals, storefront technology, intake and checkout flows, order coordination, and related services that link to these Terms. If you use a storefront operated by a clinic, pharmacy, medspa, wellness brand, or other business, that business may also have its own terms, consents, and policies.
1. Agreement to these terms
By accessing or using The Rx Spot services, you agree to these Terms and to our Privacy Policy. If you use the services on behalf of an organization, you represent that you have authority to bind that organization. If you do not agree, do not use the services.
2. What The Rx Spot does
The Rx Spot is a B2B telehealth operations platform. We provide technology and operational tools for white-label storefronts, business portals, catalog and pricing workflows, patient intake, checkout, provider-case coordination, order status, support, and fulfillment coordination.
The Rx Spot is not a medical practice, pharmacy, or emergency-care provider. Licensed clinicians, medical practices, pharmacies, and fulfillment partners are responsible for professional judgment, clinical review, prescribing, dispensing, compounding, counseling, fulfillment, and other licensed professional services.
3. No emergency care
The services are not for emergencies. If you believe you may have a medical emergency, call 911 or seek emergency medical care immediately. Do not rely on the website, storefronts, intake forms, messages, or support channels for urgent or emergency medical needs.
4. Eligibility and account responsibilities
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the services unless a parent, guardian, provider, or authorized organization is acting as permitted by law. You agree to provide accurate, current, and complete information and to keep your account credentials confidential. You are responsible for activity under your account.
5. Patient intake, provider review, and prescriptions
Submitting an intake, questionnaire, order request, or payment does not guarantee that treatment will be approved, prescribed, compounded, dispensed, shipped, or delivered. A licensed provider may approve treatment, deny treatment, request additional information, recommend a different product or plan, or determine that telehealth is not appropriate.
You agree that the information you provide for clinical or pharmacy review will be truthful, accurate, and complete. You authorize The Rx Spot to transmit your intake, selected items, order details, payment status, and related information to the clinic, provider, pharmacy, fulfillment partner, or storefront operator involved in your request.
6. Products, pharmacy fulfillment, and shipping
Product information on the services is for general informational and operational purposes. It is not a substitute for professional medical advice, diagnosis, treatment, or pharmacy counseling. Prescription products require review by a licensed provider and fulfillment by a licensed pharmacy or authorized fulfillment partner where applicable.
Shipping times, availability, packaging, and fulfillment status may vary by pharmacy, destination, product type, provider approval, inventory, and legal requirements. You will receive available status updates through the storefront, email, portal, or support channel used for your order.
7. Purchases, payment, and authorization
When checkout is available, prices, consultation fees, shipping charges, taxes, and other charges are shown at checkout or in the applicable portal or storefront. You authorize the payment method you provide to be charged, authorized, voided, or refunded as needed to process your request, prevent duplicate charges, support provider review, coordinate fulfillment, and maintain payment records.
Payment methods may include the methods displayed at checkout. Payment details may be processed through third-party payment processors and tokenization services, including USA Payments/NMI where configured. The Rx Spot may refuse, cancel, or limit an order or request if information is incomplete, payment fails, fraud or misuse is suspected, provider or pharmacy review fails, a product is unavailable, or fulfillment would violate law, policy, or operational requirements.
8. Cancellations, refunds, and returns
If you need to cancel or modify a request, contact support as soon as possible. Timing matters: cancellation and refund options depend on whether payment has been authorized or captured, whether a licensed provider has reviewed the intake, whether a pharmacy has started processing or dispensing, and whether an order has shipped.
- If treatment is not approved or a medication order cannot be fulfilled, medication charges are generally refundable when they have not already been fulfilled, subject to applicable law and the specific checkout flow.
- Consultation, provider-review, platform, shipping, and processing-related fees may still apply after review, submission, authorization, or fulfillment activity has begun.
- Prescription, compounded, personalized, refrigerated, or dispensed products may have limited return or refund availability for safety, legal, and pharmacy reasons.
- If you believe a charge, shipment, or fulfillment result is incorrect, contact us at support@therxspot.com so we can review the order status and available remedies.
9. Business and storefront users
Clinics, medspas, wellness brands, pharmacies, representatives, and other business users are responsible for maintaining appropriate licenses, permissions, customer consents, storefront content, pricing choices, product claims, support contacts, and compliance with laws that apply to their business. Separate written agreements, platform agreements, business associate agreements, data processing terms, or onboarding documents may apply to business users and control where they conflict with these public Terms.
10. Acceptable use
You agree not to misuse the services. Prohibited activity includes:
- Providing false, incomplete, misleading, or unauthorized information.
- Using the services to seek products or prescriptions unlawfully or for resale, diversion, or non-medical purposes.
- Accessing accounts, data, storefronts, APIs, payment flows, or provider workflows without authorization.
- Interfering with security, payment idempotency, provider dispatch, order records, audit logs, or platform availability.
- Uploading malware, abusive content, unlawful content, or content that violates another party's rights.
- Scraping, copying, reverse engineering, or commercially exploiting the platform except as expressly allowed by The Rx Spot.
11. Intellectual property
The services, website, portal interfaces, storefront templates, software, workflows, text, graphics, logos, designs, and other content are owned by The Rx Spot or its licensors and are protected by intellectual property laws. Subject to these Terms, we grant you a limited, revocable, non-transferable right to access and use the services for their intended purpose.
12. User content and communications
If you submit content, messages, feedback, files, images, questionnaire answers, storefront assets, or other materials, you represent that you have the right to provide them and that they are accurate and lawful. You grant The Rx Spot the rights needed to host, process, transmit, display, store, secure, and use those materials to operate, improve, support, and protect the services.
13. Privacy and electronic communications
Our Privacy Policy explains how information is collected, used, disclosed, and protected. By using the services, you consent to electronic communications, electronic records, electronic signatures, account notices, order updates, support messages, and service-related communications. If SMS is used, message and data rates may apply and opt-out instructions will be provided where required.
14. Disclaimers
The services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, The Rx Spot disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, error-free operation, and accuracy of content. We do not control the independent professional judgment of licensed providers or pharmacies.
15. Limitation of liability
To the fullest extent permitted by law, The Rx Spot and its owners, directors, officers, employees, contractors, vendors, and partners will not be liable for indirect, incidental, consequential, special, exemplary, punitive, lost-profit, lost-data, or business-interruption damages arising from use of the services. Some jurisdictions do not allow certain limitations, so some limits may not apply to you.
16. Indemnification
You agree to defend, indemnify, and hold harmless The Rx Spot from claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys' fees, arising from your misuse of the services, violation of these Terms, unlawful content, inaccurate information, violation of another party's rights, or violation of applicable law.
17. Changes, suspension, and termination
We may update, suspend, discontinue, restrict, or change the services at any time. We may suspend or terminate access if we believe these Terms have been violated, continued access creates risk, payment fails, information is inaccurate, or legal or operational requirements require it. Updated Terms will be posted on this page with a new "Last updated" date.
